چکیده

این مقاله نقش زمان و مکان در فقه، تاثیر آن در تغییر آراء فقها و رابطه آن با حقوق زنان را مورد بررسی قرار داده است. زمان و مکان دو عنصر تاثیرگذار در فقه است و عاملی مهم در تغییر وتبدیل آراء فقها محسوب می‏شود. منظور از آن دگرگونی‏هایی است که در جامعه انسانی به وقوع می‏پیوندد و سبب می‏شود که حکم به تبعیت از موضوع تغییر یابد، فتوای فقیه عوض شود و در نتیجه فهم انسان از دین نیز متحول شود. مسأله تأمین حقوق زنان و اصلاح یا وضع قوانین جدید در این زمینه از مدتها پیش مطرح بوده است. در ایران نیز همانند برخی از کشورهای اسلامی، در زمینه چگونگی سازش میان شرع - که از طریق فقه و استنباط فقها تجلی می‏یابد - با زمان و مکان و نیازها و ضرورتهای متعلق به آن، مباحث زیادی مطرح شده است. زیرا طبق قاعده کلی، در نظام حقوقی ما هرگونه اصلاح و یا وضع قوانین جدید تایید نظر فقها را لازم دارد که این وابستگی، ضرورت توجه به زمان و مکان در فقه و آراء فقها را محسوس‏تر می‏کند. باید توجه داشت که در وضعیت فعلی و با تکیه به آراء موجود فقهی، امکان تغییر و اصلاح بعضی از قوانین مربوط به زنان وجود دارد.

Time and Location in Islamic Jurisprudence: Legislation Changes in Women's Rights

چکیده [English]

This article discusses the role of time and location in jurisprudence, its’ impacts on the changes of jurisprudent’s opinions and it’s relation with women’s rights. Time and location are two important factors in these processes. That is changes in the society causes changes in decrees, in judgments and as the result evaluation in the people’s understanding of religion.
Provision of women’s rights with reforms or enactment of new laws is an old debate. In Iran like some other Islamic countries the issue of the adaptation of religious rules time, location, needs and necessities have been a major issue for discussion. Based on the legal system of Iran, any type of reforms in the present laws or development of new law should be approved by jurisprudentes. Such a situation of dependency adds to the importance of taking time and location into consideration by jurisprudentes. It is noticeable that, at present and with the existing jurisprudentes’ opinions, reforms, and changes in some laws regarding women’s rights is possible.
